AI image generation ownership

I Made This - dctr.pro/2pq @siracusa talking about ownership and AI. Back in Jan. US law has also been moving on this and the topic of ownership came up in my AI workshop last week when I used Midjourney as part of it Here is a link to the terms updated in March 2024 - docs.midjourney.com/docs/term…

As I assumed you do own the images created but you also give Midjourney rights to all your prompts and any images produced in the system (service).

Images and prompts whenever they are posted are done in a public setting by default, the images are publically viewable and thus remixable.

However if you purchase the Stealth feature as part of Your “Pro” or “Mega” subscription Midjourney agrees to make best efforts not to publish any assets

Previously it seemed for free accounts Midjourney claimed to licence the files to you under a non commercial Creative Commons licence this no longer seems to be the case. The only exceptions now relate to upscaling other peoples work the original owner still owns the work and if you earn more than $1,000,000 USD a year in revenue you have to be subscribed to pro or mega packages.
